Terms of Service & Community Guidelines
These Terms of Service govern your access to and use of the Amethyst Platform (including Amethyst Hub, Amethyst Web Browser, and Amethyst Server APIs).
1. Nature of the Service (Non-Commercial Community Project)
The Amethyst Platform is provided as a free, non-commercial open-source and hobby community service operated by a private individual. No fees are charged, and no commercial subscription plans are sold. The service is provided on an "as is" and "as available" basis.
2. Eligibility & Account Registration
To publish projects or engage with community features (likes, follows), you must register an account. You are responsible for keeping your login credentials confidential and for all activities that occur under your account. You agree to provide accurate information and refrain from impersonating other individuals or entities.
3. User Content & Intellectual Property Warranties
You retain ownership of any original lightshow patterns, MIDI layouts, and creative files you create. However, by uploading or publishing any project package (including .zip, .rar, .ame, or .arcade archives, audio files, images, or metadata) on Amethyst, you represent and warrant that:
- Rights Ownership: You own all intellectual property rights, copyrights, and neighboring rights to the uploaded content, or you have obtained all necessary written licenses, authorizations, and permissions from the respective rights holders (including music publishers, composers, and record labels).
- No Infringement: The content does not infringe any copyright, trademark, trade secret, privacy right, or other proprietary right of any third party.
- Audio Recommendation ("Chart without Audio"): For performances created for commercial songs, we strongly encourage uploading only the project trigger file (lightshow / MIDI) without the master audio track and supplying external links to authorized streaming services (e.g. Spotify, Apple Music).
4. License Granted to Amethyst
By submitting or uploading content to the platform, you grant the Amethyst Platform and its operator a worldwide, non-exclusive, royalty-free, transferable license solely to host, store, cache, reproduce, format, transmit, and publicly display such content as necessary to operate, maintain, and provide the platform to users worldwide.
5. Prohibited Content & Activities
You agree not to upload, transmit, or share content that:
- Infringes upon any third-party copyright, patent, trademark, or trade secret.
- Contains unauthorized copies of commercial sound recordings or musical compositions.
- Contains malicious code, viruses, spyware, trojans, or destructive scripts.
- Attempts to reverse engineer, abuse, or overload the platform's backend infrastructure or bypass rate limits.
6. Content Moderation, Suspension & Takedown (Art. 14 & 16 DSA)
Under the EU Digital Services Act (Regulation (EU) 2022/2065) and the US Digital Millennium Copyright Act (DMCA), Amethyst operates as a neutral hosting provider. We reserve the absolute right, in our sole discretion, to:
- Immediately suspend, block, disable, unpublish, or delete any project, account, or file that is subject to a copyright complaint, notice of infringement, or violation of these Terms.
- Terminate or restrict access for users who repeatedly infringe intellectual property rights ("repeat infringer policy").
If your project is suspended due to an intellectual property notice, you will receive a statement of reasons and an opportunity to submit a counter-notice in accordance with our Notice & Takedown Policy.
7. Indemnification (Freistellungserklärung)
You agree to defend, indemnify, and hold harmless the operator of the Amethyst Platform, its contributors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees and court costs) arising out of or relating to:
- Your violation of these Terms of Service.
- Any content, audio track, project archive, or material uploaded or shared by you through the platform.
- Your infringement or alleged infringement of any copyright, trademark, or other intellectual property right of any third party.
8. Limitation of Liability (Haftungsausschluss nach §§ 521, 599 BGB)
Because the platform is provided entirely free of charge and without compensation, statutory liability is governed by the principles of gratuitous service (§§ 521, 599 of the German Civil Code - BGB):
- The operator shall only be liable in cases of intentional misconduct (Vorsatz) or gross negligence (grobe Fahrlässigkeit).
- Liability for simple negligence, data loss, downtime, or incidental damages is excluded to the fullest extent permitted by law.
- We do not warrant uninterrupted or error-free operation of the services.
9. Applicable Law & Severability
These Terms are governed exclusively by the laws of the Federal Republic of Germany, without regard to its conflict of law principles. If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
